A BILL to repeal section seven, article two, chapter nine of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended; and to amend article nine of said chapter by
adding thereto a new section, designated section twenty-one,
relating to permitting limited transfers of moneys
appropriated for temporary assistance to needy families for
purposes of child care, job training and transportation
programs; repealing an archaic provision relating to the work
incentive program.
Be it enacted by the Legislature of West Virginia:
That section seven, article two, chapter nine of the code of
West Virginia, one thousand nine hundred thirty-one, as amended, be
repealed; and that article nine of said chapter be amended by adding thereto a new section, designated section twenty-one, to
read as follows:
ARTICLE 9. WEST VIRGINIA WORKS PROGRAM.
§9-9-21. Transfer of funds for child care, job training, and
transportation.
The secretary of the department of health and human resources
is authorized to transfer in any budget year moneys appropriated
for temporary assistance for needy families, that he or she
determines are not needed to provide cash assistance for needy
families, in order to provide additional funding for child care
services, job training or transportation services for needy
families. Notwithstanding any provision of this code to the
contrary, the secretary may not transfer any moneys so appropriated
for any other purpose.
NOTE:The purpose of this bill is to permit the secretary
of the department of health and human resources to transfer moneys
appropriated for temporary assistance to needy families for
purposes of child care, job training and transportation programs.
